AI Act Article 50: what a chat or voice agent must tell people

Article 50(1) of the EU AI Act requires providers to design AI systems that interact directly with natural persons so that those persons are informed they are dealing with an AI system, unless that is obvious from the context.

Since when?

Article 50 applies from 2 August 2026 (Regulation (EU) 2024/1689). The Digital Omnibus on AI, Regulation (EU) 2026/1744 of 8 July 2026, postponed the high-risk rules but did not move this duty. It only gave providers of generative systems already on the market before 2 August 2026 until 2 December 2026 to meet the separate marking duty in Article 50(2).

What it means for agents

A voice agent answering a customer line, a chat agent replying to consumers or an agent that phones a supplier's staff is interacting with natural persons. An agent calling another company's API is not.

EnglishPlease note: you are talking to an AI assistant of [company]. On request we will connect you to a human.

The offer to reach a human goes beyond what Article 50(1) requires. We include it because callers ask for it. DutyKit's ki_hinweis tool returns these texts with the company name filled in, plus a Luxembourgish version that a native speaker has not yet reviewed.
